In many cases MACHUPICCHU GATEWAY has the responsibility of choosing programs and services appropriate to your abilities and interests. In order to provide you with the professional experience of all our staff.

Adventurers must be in good health when accepting the trip and also prepare for the trip, studying the itinerary, to bring the appropriate clothing, equipment and personal documentation as advised.

Reservation procedure

Once you have chosen the tourist service you must be subject to comply with each of the clauses or terms and conditions, it will be mandatory to read them, therefore, once full or partial payment has been made, you will be satisfied and affirm that you have read and accepted them.

Your reservation is subject to the terms listed below.

The other 50% of the service will be provided by you at the time of the briefing at the hotel where you are staying or upon arrival in the city of Cusco.

Organization and Responsibilities

MACHUPICCHU GATEWAY is a travel and tourist services agency, which has the function of carrying out the services provided by train operators, general transport operators, hotels, tour operators and/or any other independent firm.

MACHUPICCHU GATEWAY has control over the services it offers, so all travel arrangements with our agency act on behalf of our clients, organizing the means and services required on their behalf.

MACHUPICCHU GATEWAY assumes responsibility in case of accidents, losses, damages, delays, inconveniences or any other type of irregularity that may be caused by defects of any vehicle, or through situations of omission, carelessness or negligence or person hired by them, to fulfill or carry out any service or part of a tourist service offered, as a result of acts of vandalism, strikes, wars, government actions, weather conditions, or any other type of factors that imply additional expenses arising from delays, changes in itineraries or other causes.

MACHUPICCHU GATEWAY reserves the right to accept reservations and not any reservation request from any passenger, to any tour or tourist package that MACHUPICCHU GATEWAY offers, to cancel or change a tourist package, if circumstances so approve. The request for any type of service requested from our company will be understood as consent to these conditions.

MACHUPICCHU GATEWAY In case of force majeure or unforeseeable circumstances before or during the trip (accidents, strikes, earthquakes, weather factors, security conditions, political factors, denial of entry permits, health issues, among others), or simply in order to guarantee the success of the plan, the operator and/or agency may modify, replace or cancel itineraries, dates, hotels, optional services, which is accepted from now on by the passenger at the time of acquiring the services.

Included Services

Your reservation with MACHUPICCHU GATEWAY does not include in its prices the 19% VAT, applicable only to Peruvians and foreigners residing in Peru.

If a visa is required, MACHUPICCHU GATEWAY will provide advice on the case, being the exclusive autonomy of the consular authority, everything related to the procedure, the requested documents, the study, costs, duration of the procedure and the approval or rejection. In the event of a visa refusal, there will be no refund of the amounts paid by the applicant. In any case, the passenger will be exclusively responsible for the processing and compliance with the requirements reported.

The passenger will be the sole responsible for the custody of his/her luggage and travel documents. MACHUPICCHU GATEWAY may advise the passenger in the event of loss of his/her luggage or travel documents, however, under no circumstances will it be responsible for the loss, damage, deterioration or loss of said items. The Travel Agency will inform the passenger of the restrictions established by the airlines regarding prohibitions, maximum weight and number of pieces per passenger, people allowed in the attractions or tourist sites, limitations or impediments to access due to maximum quota. However, it will be the exclusive responsibility of the passenger to comply with said policies, which may vary by disposition of the transport companies or the service provider.

Documentation

The passenger is responsible for having a valid passport or other travel document and visas according to his/her nationality accepted by the laws of the governments of the countries he/she is visiting. In order to make reservations, the following information will be required for each passenger:

Full name.

Passport number.

Nationality

Date of birth

It is recommended to inform about allergies, illnesses, passenger conditions, characteristics of each passenger, food preferences, among others.

Privacy and protection of personal data

By providing the email address or other personal data, a necessary requirement for contracting tourist services, the passenger gives permission for said addresses to be used to send commercial communications for promotion or advertising of the services and products offered by MACHUPICCHU GATEWAY, guaranteeing that said information will never be sold or provided to third parties and will be protected as confidential information and will not be complied with in the event of an order from a competent authority.

Prices and Rates

Prices and rates are denominated in US dollars and are subject to change without prior notice, until the respective payment and due confirmation of availability have been made.

The tourist packages are per person, based on double occupancy in a room or standard person occupancy (unless otherwise indicated) in all hotels and include services, transfers, indicated excursions, specialized guides and entrance tickets (unless different conditions are specified). Prices and rates do not include extras, tips, airport taxes, airfare (unless otherwise indicated), excess baggage or any other travel not specified in the program.

When the passenger chooses the rate, unless otherwise indicated, it is a rate in which changes to the reservation amount are not allowed (except by paying any penalty provided by the company according to the rate applied). This means that it is not allowed to use the entrance tickets in a manner other than that contracted, including this fact by trying to use the return of the tickets, without having previously used the entrance.

Price does not include

National and airport departure taxes or visa fees, airport security charges if imposed by any airport to cover the costs of security measures, excess baggage, park entrance fees where not specified, additional nights or expenses during the trip due to flight cancellations or any international circumstances beyond the control of MACHUPICCHU GATEWAY, alcoholic beverages, mineral water, drinks, snacks or meals not specified, tips, insurance of any kind, laundry, telephone calls, radio calls or messages, flight reconfirmation and other items for personal use, special programs, optional excursions or other services not expressly specified in the program, the only supplement payable on all reservations where only one person is traveling and requires only accommodation/services.

Payment methods

The specific conditions of each plan will define the payment method and term. The value and method of payment of deposits or advances, tickets, reservations for sporting and cultural events, fairs, exhibitions and the like, will be subject to the conditions of the organizer of such events, which will be informed at the time of purchase.

A corresponding deposit per person for the chosen program is requested at the time of booking. This deposit is non-refundable in case of cancellation by the client. The balance of this program is due 60 days before departure. In the case of programs booked within 60 days of departure, the total amount of the program must be paid at the time of booking.

In the case of groups, our payment policy requires that our services must be fully paid 60 days before the arrival of the group together with the list of passengers, unless different conditions are specified.

Any modification to agreed services or the contracting of new services once the trip has begun will be paid directly by the passenger or may, if the agency accepts it, be charged to a credit card.

Payment must be made with MACHUPICCHU GATEWAY in Cusco / Peru. MACHUPICCHU GATEWAY will assume taxes in Peruvian banks and Peruvian bank transfer costs but all country of origin taxes and bank transfer costs will be the responsibility of the client.

Ways to make pre-payments for confirmation of the requested services:

VISA credit card with Verified by Visa and with Securecode (+8%).

VISA credit card through PAYPAL (+5%).

Bank deposit (For bank transfers from abroad add $20)

Reservations

All reservations are subject to confirmation until full payment is received for the services offered by MACHUPICCHU GATEWAY. If a specific agreement has been reached between the company and the client, the reservation may be confirmed with a partial payment of 50% for the packages and all their categories in which they are found. However, the balance must be paid before the start of the services.

Payments for our services can only be made as indicated in our payment methods. Once the reservation of the tourist package is confirmed to the client by email with a confirmation code, it will be guaranteed, except for cancellation for reasons stated under the title of responsibilities which are totally unrelated to the company.

Confirmation of hotels is subject to availability, if there is no space in the selected hotel, another of similar category and price will be given according to the client’s interests.

Regarding cancellations, refunds and money refunds, these will be regulated by the terms and conditions stipulated in the Cancellation, Refund and Refund Policies established by MACHUPICCHU GATEWAY.

Obligations

In the event that a service cannot be provided due to an error, failure or direct fault attributable to the service operator, MACHUPICCHU GATEWAY will try to do its best to provide a solution of equal value to the service not provided.

In the event that a service equivalent to the service not provided cannot be provided, the actual price of the service will be refunded, excluding any consequences, indirect costs or any other cost associated with the non-performance of this service.

Any claim regarding a service not provided during the trip will only be accepted if it is made in writing within 7 days after the trip has ended.

Regarding cancellations, refunds and money refunds, these will be regulated by the terms and conditions stipulated in the Cancellation, Refund and Refund Policies.

Cancellation, Refund & Return Policies.

MACHUPICCHU GATEWAY will not be responsible for, nor will it make any kind of refund or postponement for services not taken or in case the passenger does not show up or arrives late on the reserved date, time and place indicated in the reservation confirmation.

MACHUPICCHU GATEWAY will not be responsible for refunding any hotel charges, extras or additional charges that the passenger has made during his stay and made for previous concepts.

Any confirmation, modification, variation, cancellation and/or news regarding each reservation will be made through the means specified in www.machupicchugateway.com otherwise the passenger will lose the right to claim their benefits.

Requests for modification to the number of people included in the previously confirmed reservation will be subject to availability of places, and their rate may vary with prior notice.

If the passenger leaves the hotel before the previously confirmed date, the refund will be subject to the hotel policy where the passenger stayed.

Any additional service contracted with other operators by the passenger at the travel destination will be the sole and exclusive responsibility of the person who contracts it, therefore, MACHUPICCHU GATEWAY will not be responsible for any inconvenience or accident that may occur.

MACHUPICCHU GATEWAY will not assume any responsibility for legal matters or other inconveniences in which the passenger may be involved, in the event that the passenger is forced to withdraw from the contracted services for such reasons and also for the personal expenses incurred by the passenger.

Individual passengers and group passengers

If a cancellation request is received up to and including 60 days before the arrival date of the passengers, the refund or reimbursement will be subject to a penalty of 30% of the total cost for administrative expenses, excluding the financial expenses associated with the cost of the bank transfer, credit card commission and any other expense and/or cost associated with the refund. Except for exceptions specified below. If a cancellation request is received up to and including 60 days before the arrival date of the passengers, the refund or reimbursement will be subject to a 40% cancellation fee, excluding the financial expenses associated with the cost of the bank transfer, credit card commission and any other expense and/or cost associated with the refund. Except for exceptions specified below. If a cancellation is received 35-20 days before the arrival date of the passengers, the refund or reimbursement will be subject to a 65% cancellation fee, outside of the financial costs associated with the cost of the bank transfer, credit card commission and any other expenses and/or costs associated with the refund. Except for exceptions specified below. No refund or reimbursement will be granted if the cancellation request is received up to or less than 19 days before the arrival date of the passengers. Likewise, no refund or reimbursement will be granted in the event of no-show of the passenger(s) or cancellation during the trip. There is no refund or reimbursement for portions of unused tour packages or stays.

In the case of cancellation of tour packages that include air, bus and/or train transportation services already issued, no refund or reimbursement will be granted for these services.

Certain services may be interrupted or cancelled due to weather conditions, force majeure, riots, etc., or other reasons beyond the control of the hotels, airlines, suppliers or the agency itself. No refund or reimbursement will be granted as a result of these interruptions or cancellations beyond our control.

Customer Responsibilities

Bring the travel requirements and everything related to current documentation such as passport, visas, travel authorizations, health insurance, registration of minors, among others. MACHUPICCHU GATEWAY will not be responsible for any damages or losses that may be caused due to lack of documents or their validity.

Take care of all your personal items and luggage.

Be punctual at the stipulated time of the contracted services.

Present the Vouchers for each of the contracted services.

In the event that the passenger is a NO SHOW at the airport, because they did not notify in advance of a flight change or cancellation, the service is considered provided and there will be no refund.

Commit and agree to follow the instructions of the guides in charge of the operation and failure to comply will result in the withdrawal from the activity without the option of a refund or postponement. The authority of the guides will not be discussed under any circumstances by any of the passengers, nor will their ability and professional judgment to make a decision in favor of individual or group safety be questioned.

Complaints and Claims

If a client has a complaint against the client’s company, they must inform the tour conductor, guide or company representative while on the tour so that the guide/representative can attempt to resolve the problem. Any other complaint must be put in writing to the company within 7 days of the end of the tour.

Venue for all claims or disputes shall be exclusively in Cusco, Peru, whose courts, using Peruvian law, shall have exclusive jurisdiction. Claims for damages against MACHUPICCHU GATEWAY shall be limited to the value of the particular item in dispute.

Any liability is limited to the full price paid for the tour. In all cases, the company specifically excludes any liability for indirect, incidental or consequential loss or expense, including loss of profits.

MACHUPICCHU GATEWAY assumes responsibility for representations it makes, but not for those made by other persons including, but not limited to, any employee of MACHUPICCHU GATEWAY or any independent travel agent.

Payment for reservations on any MACHUPICCHU GATEWAY program or tour shall constitute consent to all provisions of the booking Terms and Conditions set forth herein and is binding on all participants of the tour.
